How To Defend Yourself in Traffic Court

While you may think you have grounds to fight your traffic ticket, you should be prepared to do so on your own. In traffic court as in all other courts: it is not your duty to prove you were right or there was no mistake. However, it is the state’s responsibility to show evidence that you were guilty of traffic violation charges.

After getting all your documents, check your state vehicle code. In the case of a violation, compare your conduct to the Code to ensure that you can actually have a defense point. One should also capture pictures of the place where the said act was executed in order to have a prove that the state is wrong. Furthermore, one should read a car’s odometer to be certain that the odometer is not defective. In traffic court it is very important that you do not go against the judge’s opinion during the traffic court hearing.

Ensure you are well dressed and be calm, and friendly when you are attending the interview. When you need to talk with a judge, you should address him or her as “Your Honor.” Make sure you don’t get into an altercation with the judge. Moreover, ensure you present all your witnesses together with you in the court. Perhaps, you need to subpoena them. The subpoena forms can be gotten in the court. Eyewitnesses are useful when it comes to supporting your story of what happened, and, as a result, the ticket can be dismissed. Everybody who have been in a car during the accident should also be considered for the witness stand. At the hearing ask for a discharge of your case and produce all your collected evidences.

But above all, do not miss your chance and exercise the right which is given to you by law allowing you to question the police officer who issued you a speeding ticket. When you’re being cross-examined be calm and be polite to the police officer throughout the process. If the police officer starts to ask you questions, just tell him to stop it and that he is not a lawyer. It is highly recommended for one to avoid a jury trial because; sometimes jurors do not have any empathy towards a defendant in traffic violation charges.

The only efficient way to defend yourself in the court is to argue that it was not your car that was scanned for speeding or you weren’t the one behind the wheel. If you prosecuted your case to the best of your abilities, and the judge found you guilty, there is no use arguing with the ruling.
